Affiliate Program Agreement

This Affiliate Program Agreement ("Agreement") governs your participation as an affiliate in the AI to Elementor affiliate program (the "Program"). Please read it carefully. By applying to or participating in the Program, you agree to be bound by this Agreement.

1. Parties

This Agreement is between you ("Affiliate", "you", "your") and Internet Wizard Ltd, a company registered in England ("Company", "we", "us", "our"), operator of AI to Elementor at aitoelementor.com.

This Agreement is in addition to our Terms & Conditions and Privacy Policy, which also apply to your use of the Service.

2. Enrollment and Approval

  • You must be at least 18 years old and provide accurate, complete information in your application.
  • Applications are reviewed and approved manually. We may accept or decline any application at our sole discretion, and may suspend or terminate an account at any time for breach of this Agreement.
  • You are responsible for the security of your affiliate account credentials.
  • Participation is free. You earn only the commissions described below; we owe you no other compensation.

3. Commissions

50% recurring. You earn 50% of the net sale price on each qualifying initial subscription and 50% of each qualifying renewal payment, for as long as the referred customer's subscription remains active and you remain an affiliate in good standing.
  • Net sale price means the amount actually paid by the customer, excluding taxes (e.g., VAT), shipping, currency-conversion costs, and any discounts or fees.
  • A referral is qualifying only if it is tracked through your referral link, results in a completed, paid order, and is not refunded, charged back, cancelled, or fraudulent.
  • Commissions for renewals are credited automatically when the renewal payment is successfully captured.
  • We may change commission rates prospectively; changes do not affect commissions already earned.

4. Referral Tracking and Attribution

  • Referrals are tracked using a cookie with a 60-day attribution window from the customer's click on your referral link.
  • Attribution is generally last-referrer: if a customer clicks multiple affiliate links, the most recent valid referral within the window is credited, subject to our tracking system's rules.
  • Tracking depends on the customer's browser accepting cookies and completing checkout on our site. We are not liable for referrals that cannot be tracked for reasons outside our reasonable control.
  • Self-referrals are not permitted. You may not use your own referral link to purchase for yourself, your business, or connected parties.

5. Payments

  • Approved commissions are paid via Stripe. You are responsible for providing valid payout details and for any payment-processor requirements.
  • Commissions become payable only after they have cleared the applicable refund/return window and are confirmed not refunded or charged back.
  • You are solely responsible for all taxes on commissions you receive. Where required, you must provide valid tax information.
  • We may withhold or delay payment where we reasonably suspect fraud, a breach of this Agreement, or invalid referrals, pending investigation.

6. Refunds and Chargebacks

If a referred order is refunded, cancelled, or charged back, the associated commission is reversed and deducted from your balance. This applies to both initial and renewal commissions.

7. Promotional Conduct

You agree to promote AI to Elementor honestly and lawfully. You must not:

  • Send spam or unsolicited messages, or post on platforms in violation of their rules.
  • Bid on our brand terms (e.g., "AI to Elementor", "aitoelementor") or confusingly similar variants in paid search, or use our brand in your domain, ad display URLs, or social handles.
  • Use cookie stuffing, forced clicks, iframes, malware, or any deceptive tracking technique.
  • Make false, misleading, or unauthorized claims about the product, pricing, guarantees, or earnings.
  • Misrepresent yourself as the Company or an official representative, or register the Company's trademarks.
  • Operate coupon, deal, or cashback sites that misuse non-public or unauthorized discount codes.

You must clearly disclose your affiliate relationship wherever you promote, as required by the FTC and equivalent laws in your jurisdiction.

8. Use of Brand Assets

We grant you a limited, non-exclusive, revocable license to use the banners, copy, logos, and other creatives we provide, solely to promote AI to Elementor under this Agreement. You may not modify our logos or create derivative marks. All goodwill arising from such use belongs to the Company. This license ends when your participation ends.

9. Term and Termination

  • This Agreement begins when your application is approved and continues until terminated.
  • Either party may terminate at any time, for any reason, with or without notice.
  • On termination, your referral links are deactivated. Commissions validly earned and not subject to reversal before termination remain payable, except where termination is due to your fraud or material breach, in which case unpaid commissions may be forfeited.

10. Disclaimers and Limitation of Liability

The Program is provided "as is". We do not guarantee any minimum traffic, conversions, or earnings. To the fullest extent permitted by law, the Company is not liable for indirect, incidental, or consequential damages, and our total liability under this Agreement will not exceed the total commissions paid to you in the three (3) months preceding the event giving rise to the claim.

11. Changes to the Program

We may modify this Agreement, commission rates, the cookie window, payout methods, or any other aspect of the Program at any time. Material changes will be posted on this page with an updated date. Your continued participation after changes take effect constitutes acceptance.

12. Independent Contractors

You and the Company are independent parties. This Agreement does not create any partnership, joint venture, agency, franchise, or employment relationship. You have no authority to make commitments on our behalf.

13. Governing Law

This Agreement is governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction over any dispute, without regard to conflict-of-law principles.
